TERMS AND CONDITIONS

THE FOLLOWING IS AGREED AND ESTABLISHED:

Art. 1 – DURATION
The company Giuliani Charter srl (Company / Shipowner) rents the pleasure craft called ………………….; this contract has a duration of 1 days at the end of which it is not automatically renewed. The boat will be available for boarding at the port of………………. on the day ……………….. at ………………………

Art. 2 – PRICE AND PAYMENT
The hirer undertakes to pay the agreed price as follows: 50% of the agreed price at the time of booking. The balance 2 days before boarding. All the sums indicated above must be received within the agreed terms. Failure to pay one of them and failure to comply with the relevant terms will result in the legal termination of this contract, legitimizing the shipowner to withhold all payments received, without prejudice to the request for further compensation for damages.

Art. 3 – DELIVERY
The owner will make the boat available to the charterer in a good state of seaworthiness, complete with all appliances, suitable for carrying out the navigation covered by this contract and ready to take to the sea. The Company declares under its own responsibility that it has all the requisites, permits and authorizations to carry out the activity of the shipping company, and that it has registered 1 boat for charter with the competent harbor master’s office.

Art. 4 – NON-DELIVERY
If the shipowner for any reason not dependent on force majeure is unable to make the unit available to the hirer in the place and within the established times, the hirer will have the right to: withdraw from the contract (this waiver must be communicated to the shipowner) and demand reimbursement of the price paid, but without any right to compensation for damages extend the contract by a number of days corresponding to the delay compatibly with the commitments already made by the shipowner.

Art. 5 – WAIVER OR INTERRUPTION
If the charterer intends to withdraw from the contract, he must promptly notify the ship owner, who will return the received deposit according to the following terms:
Total refund of the deposit with notice of withdrawal at least 45 days before the boarding date.
Refund of 50% of the deposit with notice of at least 30 days before boarding.
No refunds from 15 days before boarding.

Art. 6 – INSURANCE
It is the owner’s responsibility to insure the boat against all risks of navigation. The ship owner is the holder of an insurance policy with adequate coverage against the civil liability of the transported.

Art. 7 – CREW
The owner will deliver the boat with a regular crew whose salary will be entirely at his expense. The Commander will have the obligation to carry out any order or directive issued by any authority and may at its sole discretion divert navigation in order to ensure the safety of passengers.

Art. 8 – ITINERARIES
The use of the boat is limited to the Gulf of Naples and Salerno. The charterer has full right to have the cruise and navigation program to be carried out as established at the time of booking, compatibly with the weather conditions, which will be evaluated exclusively by the captain, together with the safety of the port and its anchorage.

Art. 9 – METHOD AND LIMITS OF USE OF THE UNIT – PROHIBITIONS
The charterer undertakes not to sub-rent and / or transfer the boat to others for any reason and declares to use the boat exclusively for pleasure, for himself and / or for his family, guests or service personnel. The transport of animals, paid passengers, goods and any type of trade is prohibited. The number of people on board may in any case exceed the maximum allowed by the maritime authority even in port. It is also forbidden to let strangers on board without the authorization of the captain. The charterer will not be able to bring on board drugs (not even for personal use), weapons, other objects and documents whose possession is not permitted in accordance with the provisions of customs regulations and Italian laws. He will not be able to behave contrary to mutual respect and good practice. In the event of the presence of minors on board, the charterer will be fully responsible for their safety, their conduct and under no circumstances can they be left alone without the supervision of their parents or caretakers. The unit, by its nature and structure, may not be appropriate for people with disabilities, or those suffering from serious medical conditions. The hirer, at the time of booking, must inform the Company of his / her pathology for possible verification of compatibility. In the same way, food intolerances / allergies must be reported upon booking process. All people on board, including minors, must be in possession of a valid identification document.

Art. 10 – CURRENT EXPENSES
Expenses relating to moorings, anchoring costs, rental of special electrical and water outlets in the marina, national tourist taxes for entry into marine parks, landing taxes, medical expenses, are the responsibility of the charterer.

Art. 11 – RETURN
The charterer undertakes to promptly return the boat to the ship owner within the deadline and in the pre-established port, for this purpose he will agree with the captain a return route such as to ensure timely delivery with reasonable approximation and therefore in the event of evident adverse weather forecasts to anticipate the return. The charterer is required to return the boat in the same conditions of use in which it was delivered and undertakes to compensate for any damage, breakages and burns to the on-board furniture, supplies, laundry costs for stained upholstery and to the things in use.


Art. 12 – FAULTS
If, during the rental and for an act not attributable to the ship owner, the boat suffers a damage that affects its use, the owner will be required to replace the boat with one of similar or superior characteristics.

Art. 13 – ADVERSE WEATHER CONDITIONS
The Company assumes no responsibility for any interruptions of the tour that may take place due to adverse weather conditions and / or for provisions issued by the maritime authorities.

Art. L4 – JURISDICTION
Any dispute regarding the interpretation or execution of this contract will be referred to the Torre Annunziata court.

Art. 15 – REFERENCE TO LAW RULES
Although not expressly established in this contract, reference is made to the Italian laws in force.
